Nepal Bar Association (NBA) Condemns House Dissolution, Demands Constitutional Restoration

The Nepal Bar Association, an organization dedicated to the rule of law, the independence of the judiciary, and the protection of human rights, strongly condemns the decision made by the President on Friday, September 12, 2025, to dissolve the House of Representatives and form a new government.
NBA Condemns House Dissolution
The Association concludes that this decision is arbitrary and unconstitutional, and is in direct opposition to the rule of law, constitutional supremacy, and constitutionalism.
This move is a serious blow to the long and arduous struggle of the Nepalese people for democracy, and it aims to undermine hard-won achievements such as democracy, a republic, and inclusive federalism. Nepal’s current constitution is the result of a broad national consensus and reflects the aspirations of its citizens.
The President’s decision to dissolve the House of Representatives also goes against the previous decision of the Supreme Court to reinstate the parliament.
As a vigilant protector of democracy, the rule of law, the independence of the judiciary, and human rights, the Nepal Bar Association strongly denounces this action. Such acts erode public trust in democratic institutions and threaten the very foundation of our constitutional system.
Therefore, the Nepal Bar Association urgently demands the immediate restoration of democracy and the unwavering adherence to constitutional supremacy.
We call upon all stakeholders to respect the will of the people as enshrined in the constitution and to be vigilant against any actions that could destabilize the democratic achievements gained through great struggle.
The Nepal Bar Association remains steadfast in its commitment to protecting the constitution. We reject such regressive steps under any pretext.
In this context, the Nepal Bar Association is prepared to take any necessary action to ensure the letter of the constitution is followed and to protect the sacrificial history of the Nepalese people, and we call on the general public to collaborate with us in this endeavor.

You also played a role in creating this situation. If your statement had been even half as authoritative on the day of the crisis, perhaps we would not be facing a constitutional deadlock today. On that crucial day, instead of pressuring the government to take responsibility, why did you remain passive?
Gen Z lawyers disagree with this press release. Without considering the principle of the Doctrine of Necessity, which was applied to address the immediate national crisis, and without holding broader discussions, the Nepal Bar Association hastily issued this statement.
It now feels as though even within the judiciary, Gen Z lawyers must begin their own protest.
