Nabil Bank Collateral Property Auction
Auction Process Details and Legal Framework
The bank is proceeding with the public auction under applicable laws following the non-settlement of outstanding loan liabilities by the borrowers within the previously issued demand period.
- Background and Precedent Notice: The bank previously published a 35-day loan recovery notice in the Abhiyan Daily on Manshir 14, 2081 B.S. demanding full settlement, which the borrowers failed to honor.
- Applicable Governing Laws: The auction and debt recovery process is conducted in accordance with the Banks and Financial Institutions Act (BAFIA), 2073 B.S., and the Debt Recovery Act, 2058 B.S. (with 2059 B.S. regulations).
- Submission Location and Contact Office: Sealed bid applications must be delivered directly to Nabil Bank Limited, Simara Branch, Bara during regular office hours.
- Submission Timeline: Bids must be submitted within 15 days from the notice publication date. If the 15th day falls on a public holiday, the deadline extends to the next working day.
- Property Condition and Quantity: The collateral properties are being sold on an “as-is, where-is” basis in their existing condition and quantity.
- Rights of Defaulting Borrowers: The auction process may be halted if the borrowers or guarantors appear at the bank and fully settle all outstanding dues prior to the scheduled auction date.
- Property Acquisition and Deficit Recovery: If no valid bids are received, the bank reserves the right to acquire the collateral assets directly. If auction proceeds fall short of full recovery, the bank will pursue remaining dues against other assets of the borrowers and guarantors.
