The recovery action follows statutory legal notices and non-compliance by the concerned parties.
- Prior Notice History: The bank previously published a 35 day public notice on June 20, 2024, directing the borrowers and guarantors to settle all outstanding principal and interest. The obligations remained unfulfilled.
- Legal Framework: The auction process is conducted under the provisions of the Banks and Financial Institutions Act 2073 alongside the internal recovery guidelines and procedural rules of Nabil Bank Limited.
Bidding Terms and Submission Guidelines
- Eligible Bidders: Interested individuals, registered firms, corporate entities, and eligible institutions may participate in the confidential sealed-bid process.
- Document Procurement & Submission: Bidders can procure and submit official sealed-bid forms within seven days from the publication date during regular office hours. If the final submission day coincides with a public holiday, the deadline extends to the next working day.
- Submission Locations: Completed bid forms must be submitted to either the Loan Recovery Department at Nabil Bank Central Office in Bijuli Bazar, Kathmandu, or the Kumaripati Branch in Lalitpur.
Provisional Conditions and Asset Non-Sale Provisions
- Rights of Pre-Auction Settlement: The bank maintains that the auction process will be terminated if the borrowers, guarantors, or associated parties clear the total outstanding debt prior to the final auction execution date.
- Institutional Acquisition Option: Should the auction fail to secure a successful bidder or complete a sale, Nabil Bank reserves the right to acquire the properties directly in accordance with the Banks and Financial Institutions Act 2073.
- Deficit Recovery Measures: If the total proceeds generated from the property auction fall short of liquidating the total debt, the bank will initiate legal proceedings to attach and recover the remaining balance from other personal assets of the borrowers and guarantors under the Debt Recovery Act 2058 and corresponding regulations.
